Terms of Service
Effective July 30, 2026
These Terms are the agreement between you and Stogas LLC (“Stogas,” “we,” “us”) for our websites, dashboard, API, CLI, software, and related services (the “Services”). They are intended to state the agreement clearly. By using the Services you accept these Terms and our Privacy Policy. If you use the Services for an organization, you confirm you are authorized to accept them on its behalf.
1. Who may use the Services
You must be at least 18, or old enough to enter a binding agreement where you live with any required permission from a parent or guardian. You must comply with the laws that apply to you and to your use of the Services.
2. Accounts and credentials
We do not require an email address or other recovery identity for an account. You are responsible for your credentials, API keys, passkeys, recovery codes, sessions, and all activity you authorize. We cannot restore access if you lose your credentials and have no active passkey, recovery code, or session.
Keep credentials private and revoke anything you no longer trust. API keys are independently scoped, so rotating one key does not interrupt the others.
3. Requests, models, and confidentiality
Stogas uses confidential-computing safeguards for request processing and publishes evidence you can independently verify. These safeguards do not extend to the model provider you select, which must receive your content to answer the request and applies its own terms and privacy practices. Our catalog summarizes each provider’s published practices. You are responsible for choosing whether a model and its provider are appropriate for your data and use case.
Verification evidence describes the software and fleet serving your requests. It is not a representation about a provider’s behavior, a model’s output, or your own systems.
4. Your content and model output
You keep every right you already have in your prompts, files, instructions, and other inputs. As between you and Stogas, and to the extent permitted by law and the selected provider’s terms, you own the output. You grant us only the permission needed to process your content to deliver and protect the Services.
Model output can be wrong, incomplete, unsafe, or similar to output given to someone else. Review it before you rely on it. Do not treat it as professional advice or as the sole basis for a decision that could materially affect a person.
Client software may keep settings, drafts, or recent working content on your device. You are responsible for controlling access to that device and clearing local data you no longer want to keep.
5. Acceptable use
You may use the Services for personal or commercial work. You may not:
- break the law, violate another person’s rights, or help someone else do either;
- submit content you do not have the right to use;
- pursue fraud, exploitation, harassment, or material physical harm;
- build malware, attack systems, defeat safeguards, or seek unauthorized access;
- interfere with service capacity, billing, rate limits, monitoring, or security;
- misrepresent the source or nature of model output where disclosure is required; or
- use the Services in violation of a model provider’s applicable terms.
You must also comply with applicable sanctions, export control, anti-money-laundering, tax, and other trade or financial laws, and you may not use the Services from, for, or on behalf of any person, organization, country, or activity where law prohibits us from providing service.
6. Organizations and delegated access
Members with the applicable capabilities manage members, BYOK keys, limits, and shared balances. Grants let selected members create a limited number of their own API keys, so access can be granted and revoked without disturbing the rest of the organization. You are responsible for the people you authorize and for setting appropriate limits. Leaving or being removed from an organization ends your access to its keys, usage history, and balance.
7. Balances and payments
Amounts shown as credits or account balance are prepaid, closed-loop service credits usable only for Stogas Services. They are not money, a deposit, or an investment, they earn no interest, and they are non-transferable, non-withdrawable, and non-redeemable for cash or cryptocurrency. Except where law requires otherwise or we expressly agree, purchases are final and non-refundable.
A transfer does not automatically create a balance. We may delay, reject, or decline to credit a payment while we review fraud, sanctions, unlawful-source, security, or other compliance risk, and we may ask for information reasonably needed for that review. We may also decline payments sent with the wrong asset, network, address, or amount, or after an invoice expires. If we cannot lawfully accept, credit, or return a payment, we may hold or handle it as the law requires. Network fees, exchange-rate movement, taxes, and losses caused by incorrect payment instructions are yours. No credit exists until a payment is confirmed and accepted.
8. How usage is charged
Usage is charged at the prices published in our catalog. Each request places a hold from published pricing and settles against the usage actually reported, so what you are charged traces back to a specific request record you can inspect.
Each request settles from the billable usage and operations recorded for that request. A provider, network, timeout, capacity, or rate-limit failure with no reported usage settles at no cost. A request can remain chargeable when a provider reports partial usage, a billable operation occurred, a response was delivered, or the provider rejected content or parameters supplied in the request. We may correct clear billing errors and restrict usage when a balance is insufficient, disputed, reversed, or connected to abuse or legal risk.
9. Availability and changes
We publish live fleet status and design for graceful failure, rolling upgrades, and redundant nodes. Even so, models, providers, prices, limits, and features change, requests can be delayed or rejected, and we may modify or discontinue part or all of the Services. We give notice where the law requires it and honor service commitments stated in a separate written agreement.
10. Ownership and open source
Stogas and its licensors own the Services, branding, and content that is not yours. Our open-source components remain governed by their own licenses, and nothing here restricts rights those licenses grant you.
11. Suspension and termination
You may stop using the Services at any time and delete your account from the dashboard. We may limit, suspend, or terminate access when we reasonably believe you have breached these Terms, created security or legal risk, failed to pay, harmed the Services or another person, or when the law requires it. We will act proportionately, and where appropriate you may contact us to appeal.
12. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” and we do not warrant that they will be uninterrupted, error-free, accurate, or fit for a particular purpose. Nothing in these Terms limits a right that applicable law does not allow us to limit.
13. Limitation of liability
To the fullest extent permitted by law, Stogas and its suppliers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption. Our total liability arising from the Services will not exceed the greater of US $100 or the amount you paid Stogas in the three months before the event giving rise to the claim. These limits do not apply where law prohibits them.
14. Business indemnity
If you use the Services for a business, you will defend and indemnify Stogas and its personnel against third-party claims arising from your content, your unlawful or unauthorized use, or your material breach of these Terms, except to the extent caused by Stogas.
15. General
These Terms and the Privacy Policy are the entire agreement about the Services. If a term cannot be enforced, the rest stays in effect. Delay in enforcing a term is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a reorganization, financing, merger, acquisition, or sale. Disputes are governed by applicable law and heard by courts with lawful jurisdiction, subject to any mandatory consumer protections available to you.
16. Changes and contact
We may update these Terms. We will revise the effective date and give any notice the law requires, and continued use after an update takes effect means you accept it. Questions can be sent to ops@stogas.ai.
